1. Who we are

BizBora Hub Ltd. (“BizBora Hub,” “we,” “us”) is a software company registered in Kenya, offering custom software development, IT consulting, and our own products including BizBora and Kazi Flow.

2. Using the website

The content on bizbora.com is provided for general information about our services and products. You agree not to use the site in a way that disrupts it, attempts unauthorised access to any part of it, or interferes with other visitors’ use of it. This includes submitting the contact form with automated tools, or using it to send unsolicited advertising or anything unrelated to a genuine inquiry to us. To protect the form from abuse, we email a confirmation code to the address you provide and only receive your message once you enter it, and we may block submissions that appear automated or abusive.

How we handle personal data on the site, including analytics cookies, which load only if you accept them, is set out in our privacy policy.

3. Custom software and consulting engagements

Custom software development and IT consulting work is carried out under a separate, signed statement of work or services agreement with the client, which sets out scope, fees, timelines, and ownership of deliverables specific to that engagement. These general terms provide the background framework; the signed agreement governs the specifics of any particular project.

4. Using BizBora and Kazi Flow

Access to BizBora and Kazi Flow is provided under an account agreement between BizBora Hub and the client organisation. You are responsible for the accuracy of the data you enter, for keeping your account credentials secure, and for the activity that takes place under your account. We are responsible for keeping the product available and working as described, subject to the limitations in section 7.

5. Fees and payment

Fees for custom software, consulting, and product subscriptions are set out in the applicable proposal, statement of work, or subscription agreement. Unless that document says otherwise, invoices are due within 30 days of issue, and continued access to BizBora or Kazi Flow is conditional on fees being kept current.

6. Intellectual property

The BizBora Hub name and logo, and the BizBora and Kazi Flow products, are the property of BizBora Hub Ltd. Ownership of custom software built for a specific client is set out in that client’s individual agreement, not by these general terms. You retain ownership of the business data you enter into BizBora or Kazi Flow.

7. Disclaimers and limitation of liability

The bizbora.com website and its content are provided “as is,” without warranties of any kind, express or implied. Nothing on this website constitutes a guarantee of specific results.

To the fullest extent permitted by law, BizBora Hub Ltd. will not be liable for any indirect, incidental, special, or consequential loss, including loss of profits, revenue, or data, arising from your use of the website or, save as set out in a signed agreement to the contrary, the product or services. Where liability cannot be excluded, our total liability for any claim arising from the website or a given engagement is limited to the fees you paid us for the relevant service in the 12 months before the claim arose.

This limitation does not apply to liability that cannot be excluded under Kenyan law, or to loss arising from our gross negligence, wilful misconduct, or breach of confidentiality obligations.

8. Confidentiality

Where an engagement involves access to confidential business information, both parties agree to keep that information confidential and use it only for the purpose of the engagement, whether or not a separate non-disclosure agreement has been signed.

9. Termination

Either party may end a product subscription or consulting engagement in line with the notice period set out in the applicable agreement. We may suspend access to BizBora or Kazi Flow if fees are significantly overdue, after reasonable notice.

10. Governing law

These terms are governed by the laws of Kenya, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of Kenya.

11. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last revised. Continued use of the website or product after a change takes effect means you accept the updated terms.
